VUT licence: requirements and procedure

The VUT licence is the registration of the apartment as a tourist-use dwelling (VFT) in the Andalusian Tourism Register, the requirement for letting it to tourists in Seville. Since 2025 the prior approval of the owners' association is also required. We verify both before any proposal and, where the neighbourhood and the association allow it, we handle the licence ourselves.

First of all we check whether the apartment can operate. If it already holds a licence, we verify that it is valid. If it does not, we check that the neighbourhood admits a new registration: since 2024 Seville City Council caps tourist dwellings at 10% of the homes in each neighbourhood, and several central neighbourhoods have already reached that limit. We also review the statutes and resolutions of the owners' association, and that the apartment holds an occupancy licence or an equivalent document.

Since 3 April 2025 (Organic Law 1/2025, new article 17.12 of the Horizontal Property Act), starting tourist use of an apartment requires the express and prior approval of the owners' association, adopted by three fifths of the owners representing three fifths of the quotas. With that same majority the association may limit, condition or prohibit the activity, and set for that apartment a share of common expenses of up to 20% higher. Apartments that already held a licence before that date are not affected. If your association has not yet voted, we tell you at the first visit.

With the association's approval and the property documentation, we file the responsible declaration with the Junta de Andalucía and apply for registration in the Andalusian Tourism Register. The code of that register is what Airbnb, Booking.com and the other platforms now ask for in order to publish the listing. We handle the procedure ourselves.

Finally we review the technical requirements of the Andalusian decree on tourist-use dwellings: air conditioning, ventilation, equipment and the information that must be available to guests. Anything missing is resolved during the set-up, before the apartment is published. This is not legal advice: it is the check we carry out on every apartment before presenting a proposal.

How the procedure works

  1. Prior check

    A valid licence or a neighbourhood that admits a new registration, the statutes and resolutions of the owners' association, the occupancy licence and the condition of the apartment.

  2. Owners' association approval

    Express and prior approval of the owners' association, by three fifths of the owners and of the quotas, required since April 2025 to start tourist use.

  3. Responsible declaration and registration

    Responsible declaration to the Junta de Andalucía and registration in the Andalusian Tourism Register. Its code is what the platforms ask for.

  4. Technical requirements and equipment

    Air conditioning, ventilation, equipment and the guest information required by the Andalusian decree. The apartment is ready to be published.

What we check before a proposal

  • That the licence exists and is valid, or that the neighbourhood admits a new registration.
  • That the owners' association has adopted the approval the law requires since 2025, or can adopt it, and that its statutes do not prevent tourist use.
  • That the apartment holds an occupancy licence or an equivalent document.
  • That the apartment meets, or can meet, the technical requirements of the Andalusian decree.

Questions about the licence

Can my apartment obtain a tourist licence?

It depends on the neighbourhood, the owners' association and the apartment itself. If the neighbourhood has reached the 10% cap, the City Council does not admit new tourist dwellings. If the neighbourhood admits it, the approval of the owners' association is also required. We check this before making you a proposal and tell you plainly.

Do I need the approval of my owners' association?

Yes, if the apartment is now starting to be used as a tourist dwelling. Since 3 April 2025 the Horizontal Property Act requires the express and prior approval of the association, by three fifths of the owners and of the quotas. Apartments licensed before that date are not affected. If your association has not yet voted, we tell you at the first visit.

Do I need the national registration number (NRUA)?

No. The national rental register (Royal Decree 1312/2024) was annulled by the Supreme Court in May 2026 (judgment 620/2026) because the State lacked the competence, and the platforms no longer ask for that number: they ask instead for the code of the Andalusian Tourism Register.

What documents do I need to provide?

The title deed or a land registry extract, the occupancy licence or an equivalent document, the cadastral reference, your ID and the certificate of the association's approval where required. With those we prepare the responsible declaration. We take care of the rest of the procedure.
